At approximately 8:02 PM on March 21st, 2021, Patrol Officers were dispatched to 405 3rd Avenue for a report of an individual who brandished a handgun following a neighbor dispute. Upon arrival, two victims stated they were involved in a verbal dispute with their neighbor, Joseph T. Davis Jr., who resides on the second floor. Following said argument, it is alleged that Davis Jr. displayed a black handgun in a threatening manner and brandished it towards the victims. At this time, the victims retreated into their apartment on the first floor and proceeded to call for emergency services.
Patrol Officers located Davis Jr. in his apartment and subsequently detained him without incident. Following a search warrant for Davis Jr.’s apartment, detectives recovered a Glock 23 semi-automatic handgun, along with numerous rounds of ammunition. Davis Jr. does not have a permit to own or operate the discovered handgun. Officers also recovered a large quantity of crack cocaine which was packaged and prepared for distribution.
Davis Jr. was charged with two counts of Menacing 2nd Degree (Class A Misdemeanors), two counts of Reckless Endangerment 2nd Degree (Class A Misdemeanors), Criminal Possession of a Firearm (Class E Felony), Criminal Possession of a Controlled Substance 3rd Degree (Class B Felony), and Criminal Possession of a Controlled Substance 3rd Degree; Narcotic Drug with the Intent to Sell (Class B Felony). Davis Jr. was arraigned by the honorable Judge Sterling and, in accordance with NYS Bail Reform, released on his own recognizance.
